This book follows the protection of religious ministers in armed conflict from its roots in religious law to the present-day status of religious personnel in international humanitarian law. The details of this legal protection are discussed as well as the practice of religious ministry to troops and prisoners of war. The author provides a comparison of protection of spiritual assistance to armed forces with protection granted to civilian ministry. Considering the example of German chaplaincy, he also examines interactions of international protection with the national status of religious personnel. Finally, problematic issues as new developments in the definition of religious personnel or their role in the conflicts of the 21st century are raised and relevant recent cases identified.

"This monograph undertakes to determine the protected status of religious personnel in armed conflict, to recall the evolutions that led to this status and to identify possi­ble problems. In addition, the ontological reasons of spiritual assistance in armed conflict and its protection are discussed.

Clergy was protected in warfare since ancient times. Protection in classical canon law shifted to the domain of secular law after the emergence of the modern states in Europe. In the wake of the Red Cross Movement, military chaplains' security was safeguarded by international conventions from the 19th century onwards. The catholic church, which operates military chaplaincy in various countries world­wide, followed the developments in the succeeding decades with increasing inter­est. In Germany, for instance, chaplains of a civilly structured military ordinariate accompany troops also during deployment abroad and provide spiritual assistance to them.

Present-day international humanitarian law provides a set of norms that protect and respect chaplains exclusively attached to the military in international and non-in­ternational armed conflict in a stable manner. Civilian ministry and its personnel are also protected by their civilian nature and the respect for religious convictions and practices. Both domains approach each other by legal and factual convergence. In the context of German chaplaincy, protection of groups other than chaplains, the use of arms by chaplains and spiritual assistance to non-believers are matters of interest. Problematic issues in the international arena are violations of international humanitarian law by ministers of religion, ministry to detained "illegal combat­ants" and the role of ministers as instigators of conflicts.
